IUB issues final order on pipeline reconsideration requests

The Iowa Utilities Board has rejected three requests for reconsideration of a hazardous liquid pipeline permit for an oil pipeline through the state. 
In an order issued Friday morning, the board addressed the issues, denying each of the requests to reopen the hearing in the Dakota Access case.
The Sierra Club argued that Dakota Access had begun construction before state officials had granted permission to do so. If that is the case, Sierra Club’s attorney argued, Dakota Access’ permit should be rescinded.
IUB board members said that they are already looking into complaints about construction, and that they would address the issue in a separate order or action.
In addition to the request from the Sierra Club, which was an official party to the initial pipeline permit proceedings, a number of landowners filed motions asking the board to rethink the permit. One landowner said she would like to see the route shifted about 200 feet, so that her future business plans for her land could move ahead. Board members said that landowner’s plans were undefined and the board had no evidence supporting the owner’s claims that she had business plans for the land.
