Attorney: Lease for Twin Lakes right-of-way was not properly approved

An attorney outside of Calhoun County says a lease to allow use of a county right-of-way was not properly approved and was therefore void from the start.
Calhoun County Attorney Tina Meth Farrington sent the lease to a Carroll attorney who has worked with civil law extensively. That attorney told her that any lease with terms lasting three or more years must follow specific procedures, including being approved via a resolution read at three meetings.
“It seems the law was not followed and the entire lease is void,” Farrington told the Calhoun County Board of Supervisors Oct. 9. “It was brought up at one board meeting and (then) two meetings were held (when it was not discussed). At the next meeting, it was on the agenda and voted on.”
